Mass Tort, Product, and Consumer Litigation

“Crowell understands the business realities and advises accordingly. They give practical, real-world applicable advice.”
– Chambers USA 2022, Product Liability & Mass Torts

Aligning an understanding of today’s litigation, regulatory, and public relations challenges is key to achieving successful results both in and out of the courtroom. For product manufacturers, including those in the automotive, medical devices, pharmaceutical, and consumer products industries – as well as those with premises liability and environmental contamination concerns – we combine product and industry experience with aggressive and creative legal strategy. With an eye towards mitigating current and future risk, we work closely with clients to achieve their desired business outcomes.

Litigation. Our team has proven experience helping clients bring their products to market, protecting them in the regulatory arena, and defending them in court. This product lifecycle perspective informs our approach to litigation, both large and small, including:

“Client goals should drive litigation strategy. A thorough understanding of a client’s larger business goals often leads to resolution of broader business challenges.”
– Andrew Kaplan, Partner

  • Represent clients in class actions and some of the largest multi-district litigations in the country.
  • Serve as national coordinating counsel for clients with nationwide state and federal court litigation dockets.
  • Manage individual product liability dockets and litigate individual cases throughout the country.
  • Represent clients in arbitration proceedings of all shapes and sizes.

Regulatory. When a company faces agency scrutiny, it is critical that any legal response considers the potential impact on a defense strategy should litigation ensue – which it frequently does. Our close government contacts and vast government experience enable us to engage regulators and enforcement officials effectively, and our litigation experience allows us to minimize risk every step of the way. We regularly represent clients in front of the CPSC, FDA, and NHTSA, and have former agency officials leading our CPSC and FDA practices.

Public Relations. We work hand-in-hand with clients to quickly handle incident and internal investigations, craft appropriate responses to government and media inquiries, and develop statements to employees and other stakeholders.
