The Evolving AI Legal and Policy Landscape: Mid-2024 Update

Since the November 2022 release of ChatGPT, generative AI has been a regulatory accelerator for governance of AI writ large. Individuals, organizations, industries, and governments across the world have grappled with the implications of AI, including how it is and could be regulated using existing and new legal frameworks. For example, since our December 2023 update:
- The EU passed the AI Act, regulating artificial intelligence and outlining a risk-based approach to the deployment and use of AI systems
- Numerous US states have introduced and passed legislation regarding AI (often with nationwide implications), with a focus on deepfakes, education, liability for chatbots, intellectual property, health insurance and employment decisions, and the establishment of commissions and grants; for example:
- The California legislature introduced AB2930, which would regulate both developers and deployers of “automated decision tools”
- Colorado passed the Artificial Intelligence Act (CAIA)
- Tennessee passed the Ensuring Likeness Voice and Image Security (ELVIS) Act
- Federal agencies completed the 30-, 60-, 90-, and 180-day actions in response to President Biden’s October 2023 Executive Order
- Global powers like Australia, China, Japan, and Singapore have issued new AI frameworks and guidelines, with a divide between countries that are taking a market-driven approach and those that aren't, creating separate paradigms for developers and deployers of AI with global reach
