Overview

Recognized by Daily Journal as one of California’s “Top Antitrust Lawyers” and perennially listed in Chambers USA, clients turn to Jason Murray for antitrust litigation and counseling when it matters most to their company. As co-chair of the firm’s Antitrust and Competition Group, Jason’s practice focuses primarily on antitrust litigation for both plaintiffs and defendants; antitrust counseling and defense in connection with state attorneys general, DOJ, and Federal Trade Commission investigations; and business advice on avoiding antitrust risks in transactions, distribution practices, and competitor collaborations. Jason has tried or arbitrated numerous matters as first chair and has successfully argued before state and federal courts of appeals. He also routinely handles arbitrations before the American Arbitration Association, International Chamber of Commerce, and International Centre for Dispute Resolution.

Jason has handled a wide variety of litigation and antitrust counseling, with a particular emphasis on antitrust cartel litigation and monopolization and exclusive dealing cases for companies in the health care, technology, transportation, entertainment, and telecommunications areas, among others.

Jason also helps lead the firm’s California Antitrust Practice, which has been consistently selected by Global Competition Review as a “recommended” competition practice. It is also recognized by Chambers USA as a leading California antitrust practice.

In addition to being named one of the top lawyers in the antitrust field by Chambers USA, Jason has also consistently been selected a “Southern California Super Lawyer” in Antitrust Litigation (2007, 2009–2021). He is an active member of the Los Angeles County Bar Association’s Antitrust Section and the Antitrust Section of the American Bar Association.

Jason’s deep commitment to public service spans both his adopted home of Venice, California, and his birth country of New Zealand, where he serves on the board of trustees for a Māori trust. Closer to home, Jason works on issues of homelessness, job training, and recovery services for veterans as chairman of the board of Volunteers of America, Los Angeles, the largest provider of services to Los Angeles.

Representative Matters

  • AHF v. Prime Therapeutics (C.D. Cal.). Successfully moved to compel arbitration of a Section 1 price-fixing claim alleging conspiracy to fix prices between competitors in the pharmacy benefit management market.
  • VHS Liquidating Trust v. Centene et al. (Alameda, California). Successfully moved to compel arbitration of an antitrust conspiracy claim alleging that competing insurers had conspired to use a single software and data company to fix prices for out-of-network hospital claims.
  • Harbor Performance v. Port of LA (C.D. Cal.). Successfully moved to dismiss with prejudice a Section 1 claim alleging conspiracy between the Port of Los Angeles and a labor union to boycott a developer affiliated with a competing union.
  • PharmaRX v. GE Healthcare (C.D. Cal.). Successfully moved to dismiss with prejudice a Section 1 claim alleging conspiracy between distributors and a pharma manufacturer to exclude competitors and fix prices, affirmed by the Ninth Circuit.
  • Prime v. Kaiser (S.D. Cal.). Successfully moved to dismiss with prejudice a Section 1 claim alleging conspiracy between an insurer and providers to boycott competitors, affirmed by the Ninth Circuit.
  • In re Generics MDL (E.D. Pa.). Successfully moved to dismiss a Section 1 claim alleging a hub-and-spoke conspiracy among competitors to exchange market share and price information, and represented a major wholesaler in related state AG and DOJ investigations.
  • In re Resistors MDL (N.D. Cal.). Served as lead counsel for the largest U.S. manufacturer of resistors in an alleged Section 1 cartel. The matter settled favorably prior to class certification.
  • In re LCD antitrust litigation. Served as lead plaintiffs’ litigation counsel for Motorola Mobility Inc., Target Corp., Sears Inc., ViewSonic Corp., RadioShack, Newegg, Rockwell Corp., and others in opt-out lawsuits as part of sprawling multidistrict litigation against an alleged cartel in the market for thin-film-transistor liquid-crystal display technology used for mobile phones, computers, and televisions.
  • In re cathode ray tube antitrust litigation. Served as lead plaintiffs’ litigation counsel for Target Corp. and ViewSonic Corp. in opt-out lawsuits brought as part of multidistrict cartel litigation and related international arbitration against manufacturers of CRTs used in televisions and computer monitors.
  • In re Apple/ATTM antitrust litigation. Served as lead litigation defense counsel for a telecommunications company in Section 1 and 2 litigation over an exclusive service provider relationship for iPhones.
