Crowell & Moring Partner Laura Foggan Argues in Front of Ohio Supreme Court

Washington – January 10, 2020: Laura Foggan, chair of Crowell & Moring’s Insurance/Reinsurance practice group, presented oral arguments to the Supreme Court of Ohio while representing the National Union Fire Insurance Company of Pittsburgh, Pennsylvania, in the matter of Lubrizol Advanced Materials, Inc. v. Natl. Union Fire Ins. Co. of Pittsburgh, PA, Case No. 2018-1815. To view the oral argument, click here.

The core issue of the case involves whether an insurance policy can be used to cover all damages from a multi-year claim. Lubrizol Advanced Materials Inc. attempted to use an insurance policy with National Union Fire Insurance Company to cover a $125 million class action settlement due to failure of its piping product over a seven year period. The insurance company contends that since the policy period was for one year only, a settlement that covers seven years of product failures does not fall under the policy terms. Senior DOJ Appellate Attorney Elizabeth Hecker Joins Crowell & Moring, Bolstering Education Practice

Elizabeth Hecker, former acting deputy chief and special litigation counsel in the U.S. Department of Justice’s Civil Rights Division’s Appellate Section, has joined Crowell & Moring as senior counsel in the Litigation Group. Hecker brings more than two decades of experience leading litigation in the federal court of appeals, with a focus on cases involving education and matters related to Title IV, Title VI, and Title VII of the Civil Rights Act of 1964, and Title IX of the Education Amendments of 1972.
