The November 2022 release of ChatGPT, a chatbot powered by OpenAI’s GPT large language model, propelled generative AI into the public consciousness, with many other tech companies quickly jumping on board to develop their own generative AI-driven tools and services.

The rapid advancements and evolving applications of generative AI have raised profound and novel legal and policy questions. Evolving and unsettled questions abound regarding how the technology’s use of training data implicates intellectual property and privacy rights, how the law applies to the outputs of those models, and what shape government regulation of this technology and those who use it should take. To make matters more complicated, countries, states, and courts aren’t always aligned on the proposed answers to these questions. The legal and policy landscape surrounding generative AI is changing nearly as quickly as the technology itself.
