As part of PLI’s Internet of Things 2020: Everything in Connected NY event, Cheri Falvey will be presenting on "IoT Litigation – Identifying and Mitigating Risk" at 4:15 pm.

IoT devices are amazing. They inspire us, entertain us, educate us, even feed and convey us. When they fail, they not only confound us, they often violate our privacy because they under-protect our information, and, sometimes, they physically harm us or damage our property. What are the legal theories available to aggrieved plaintiffs? What will be the impact of the California Security of Connected Devices law, and similar bills pending in other states on IoT litigation, including class action litigation. Are there pro-active protective strategies available to vendors? What practical means mitigate the risk including indemnification, insurance, establishing privity of contract, and creating enforceable agreements with a binding arbitration clause.
