Overview

Lorenzo Gasparetti is a conscientious and dynamic lawyer, partner, and leader who possesses a unique ability to understand the issues the firm’s clients are facing and help them achieve the most advantageous and optimal solutions. As a seasoned litigator in Crowell & Moring’s Health Care Group, Lorenzo knows that the key to a positive outcome for the client is to have a deep understanding of their business, the commercial environment in which they operate, and their objectives, as well as to be able to draw upon his own litigation experience. That knowledge and experience must be combined with the ability to tap into the firm’s deep well of subject matter experience as necessary to marshal both a qualified and diverse team for the matter at hand.

Having also previously served as the practice group leader of a U.S. commercial litigation team at a large firm and serving as the managing partner of that firm’s Los Angeles office for nearly 20 years, Lorenzo is uniquely qualified to meet client’s’ needs and demands in a wide array of local, national, and international commercial disputes. He has also developed a mentoring and communication approach that provides his litigation teams with the guidance and confidence necessary to work together and always in the direction that is best suited to the needs of the firm’s clients.

Over the years, Lorenzo has handled a wide array of disputes for business clients, from high-stakes contract litigation involving numerous business sectors to high-profile catastrophic injury and wrongful death cases implicating complex insurance recovery issues. More recently, his practice has focused on commercial litigation affecting three large groups of clients – the managed health care, life sciences, and financial services industries.

In the managed health care sector, Lorenzo currently handles both large-scale and complex disputes with providers (including contractual reimbursement, out-of-network “usual, customary and reasonable” fees, billing fraud, and overpayment issues) and the defense of individual member and class-wide bad faith litigation. In the life sciences field, he has represented international pharmaceutical and medical device manufacturers in numerous commercial matters, including joint venture, collaboration, licensing, pricing, and supply and distribution disputes. Additionally, he is frequently called upon to defend financial institutions involved in claims of unfair business practices and violations of federal and state laws and regulations governing various commercial and consumer lending transactions. Where an early resolution in these cases is not possible, Lorenzo is known to be a vigorous advocate in both state (California and several other states) and federal courts as well as in numerous arbitrations.

Lorenzo is also truly a “lawyer’s lawyer,” having represented law firms and lawyers sued for legal malpractice, breaches of fiduciary duty, and conflicts of interest throughout his career. He has achieved victories for both national and international law firms in high-profile matters, handled disqualification proceedings, and successfully negotiated confidential settlements before the commencement of litigation. These professional liability cases typically involve complex underlying litigation or transactional legal work in various sectors, including real estate, corporate transactions, trusts and estates, and entertainment.

  • Lead counsel for national vision care company in a putative class action alleging violation of California’s UCL regarding lease arrangements with optometrists at “big box” retail stores.

  • Lead counsel for international pharmaceutical company in commercial litigation (federal court – Northern District of Illinois) with licensor involving royalty and change of control and assignment issues. Order granting motion for summary judgment in favor of client.
