Washington: Crowell & Moring secured a U.S. Supreme Court victory on behalf of the Alliance for Responsible Atmospheric Policy (ARAP) and the Air-Conditioning, Heating, and Refrigeration Institute (AHRI) when the Court denied RMS of Georgia’s petition for writ of certiorari in RMS of Georgia v. Environmental Protection Agency. This ruling preserves a favorable decision by the U.S. Court of Appeals for the District of Columbia Circuit regarding implementation of the American Innovation and Manufacturing Act (AIM Act). The AIM Act provides for the phasedown of the use of hydrofluorocarbons (HFC) based on their high global warming potential. HFCs are used in many important sectors of the economy including air-conditioning and refrigeration, insulating foams, industrial solvents, aerosol sprays, and laboratory equipment. ARAP and AHRI, as associations representing businesses that produce and use HFCs and their replacements, have a vital interest in the orderly implementation of the AIM Act.

In a significant and unanimous ruling, the D.C. Circuit upheld the Environmental Protection Agency’s (“EPA”) final rule designating perfluorooctanoic acid (“PFOA”) and perfluorooctanesulfonic acid (“PFOS”) as “hazardous substances” under the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”), denying the petitions of seven industry groups seeking to overturn that designation.[1] CERCLA, also known as the “Superfund Statute,” allows EPA to require potentially responsible parties to fund cleanup of hazardous substances.

State regulation of PFAS-containing products will ramp up significantly in 2026. Most notably, companies will have to comply with Minnesota’s sweeping new product-reporting requirements.  As we explain below, Minnesota’s requirements cast a wide net, capturing companies that may not sell products directly into the state. This and other features of the state’s reporting program are likely to present significant compliance challenges for a wide range of businesses.

On September 18, EPA announced that it will prioritize Toxic Substances Control Act (“TSCA”) review for “new chemicals related to data centers and artificial intelligence (“AI”) projects,” in an effort to “streamline permitting and regulations to accelerate American data center development.”

The Household and Commercial Products Association’s (HCPA’s) Pesticide Regulation Workshop, organized, hosted, and co-presented by Crowell, is the oldest and largest annual event dedicated to pesticide regulation, compliance, and enforcement under federal and state pesticide laws. As 2023 rolls in, what changes can government contractors expect? What will be the focus of the US Government? How should contractors prepare?

A failure to meet safety compliance and regulatory obligations can undo the herculean efforts to surmount supply chain challenges and get products into the US. Our Products Liability and Regulatory Compliance lawyers will discuss the impacts of current efforts by regulators to police product safety at the ports, the expectations of federal safety regulators at the ports and how to use compliance documentation to speed the process when products have been stopped for inspection. Our discussion will cover activities at CPSC, NHTSA, EPA and FDA. The panel will also discuss the challenge of counterfeit products and parts and how safety can be a lever to stop counterfeits. Given the increased costs of shipping, downstream recovery opportunities may help alleviate some of the monetary pressures and our panel will discuss these opportunities as well as the contract clauses that can allocate risks appropriately when things do go wrong.
