Jodi Daniel Named to NAM’s AI Code of Conduct Project Steering Committee

Washington – July 19, 2023: Jodi G. Daniel, partner in Crowell & Moring’s Health Care Group and managing director of Crowell Health Solutions, has been named to the steering committee for the National Academy of Medicine (NAM)’s newly launched Artificial Intelligence Code of Conduct (AICC): Toward a Code of Conduct for Artificial Intelligence in Health, Health Care, and Biomedical Science Project.

The NAM is partnering with a group of leading health, bioethics, equity, tech, patient advocacy, and research organizations to develop an Artificial Intelligence Code of Conduct and describe the national architecture required to give rise to and support equitable and responsible use of AI in health, medical care, and health research.   

Daniel brings expertise as a leading digital health lawyer and former federal policy executive. As one of the first digital health lawyers in the U.S. and a former lead policymaker at the U.S. Department of Health and Human Services, she has a broad and unique understanding of the digital health market and cutting-edge health innovation--including artificial intelligence and machine learning, remote monitoring tools, EHRs, mobile health applications, digital therapeutics, health data platforms, and data analytics tools. Prior to joining Crowell, she was the founding director of the Office of Policy on the Office of the National Coordinator for Health Information Technology at HHS, and the first Senior Counsel for Health Information Technology in the Office of the General Counsel. At HHS, Daniel helped spearhead important changes in health information privacy and health information technology to improve health care for consumers nationwide. She was responsible for establishing regulations for certificaiton of health information technology and was one of the key drafters of the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rules and Enforcement Rules.

AI raises new issues that technology developers and health care providers are grappling with, and it is imperative that there is a framework that can support these advances in a manner that meets legal and ethical standards, and the expectations of patients and health care providers.”

Stewarded by the NAM Leadership Consortium (LC), as AI is poised for a profound impact throughout the health field, the effort is a direct response to the growing call for a harmonized set of AI guidelines that can facilitate interoperable governance standards for its development and application. The NAM AI Code of Conduct initiative will draw from and build upon related work, including pathbreaking efforts of the Coalition for Health AI (CHAI). In this respect, it will aim to clarify roles and responsibilities of the many stakeholders on issues of privacy, ethics, equity, accountability, and applicability, at each stage of the AI lifecycle. The Code of Conduct will represent a “best practice” framework, subject to testing, validation, and improvement as the technology and the ability to effectively govern it progresses.

Under the strategic guidance of a multi-faceted AICC Steering Committee—comprised of ethics and equity experts, care delivery systems, tech companies, patient advocates, researchers, and payers—the NAM project will describe a national strategy for broad adoption of the harmonized Code of Conduct and describe a national architecture and priority actions to support and advance responsible AI in health, medical care, and health research.

The NAM AI Code of Conduct initiative will be developed with significant stakeholder and public input—an open process from the outset. NAM will organize informational gatherings and collaborative events and activities which will be used to inform the Code of Conduct. The goal is that the Code and national health care AI architecture be widely adopted, translated for implementation by various stakeholders, and continuously improved to realize AI’s enormous promise.
