When highly regulated entities, such as food and beverage and consumer packaged goods companies, face Federal Trade Commission and manufacturing compliance risks, advertising and marketing disputes, competition concerns, or class action litigation, Amy Marie Pauli provides targeted, actionable counsel to quickly and efficiently minimize risk or resolve disputes. Amy works with category-leading companies to navigate outdated and murky regulatory requirements to help clients achieve product innovation goals. She is also a go-to advocate when regulated entities face class action disputes or seek an experienced appellate or amicus counsel.

Amy also maintains an active pro bono practice, with a focus on amicus briefs supporting reproductive justice as well as civil appeals for low-income Coloradoans.

Representative Matters

  • Consumer class actions. Secured complete dismissal of consumer class action for pet products manufacturer in the U.S. District Court for the Northern District of California. Plaintiff sought $5 million in damages and asserted claims including fraud, breach of warranty, and that the label was misleading under consumer protection statutes. 
  • Regulatory business disputes. Represented animal product manufacturer in investigation of regulatory defects in business acquired by client and litigation for breaches of acquisition agreement. Successfully brought federal court litigation alleging more than $7 million in damages, resulting in highly favorable settlement for client. 
  • Proposition 65. Serving as Proposition 65 counsel for nationwide chip brand, animal feed manufacturer, chocolate manufacturer, and consumer product brand. 
  • State dairy regulations. Providing state dairy regulations counsel to multinational ice cream company, global beverage company, and national dairy brand. Advising regarding distribution licensing and nationwide promotional and advertising matters, including couponing and associated regulations and requirements. 
  • Food labeling counseling. Advising global beverage brand regarding product launches, advertising and marketing risks, and bottle bill compliance for various product lines including juices, sodas and carbonated beverages, flavored waters, and energy drinks. 
  • Class and collective employment actions. Secured dismissal of State Department-regulated au pair agency from a putative class action in the Eastern District of New York and California state court. Plaintiffs asserted minimum wage and overtime violations of the Fair Labor Standards Act, state labor laws, and the Private Attorneys General Act.
