Crowell & Moring Advises Stell Engineering in $4 Million Seed Funding Round

A Crowell & Moring Corporate team represented Stell Engineering in an oversubscribed $4 million seed round led by Long Journey Ventures and Cyan and Scott Banister, raising money that will help the early stage software startup continue to scale their team, refine their product, and create new supply chain functions. Third Prime, Wischoff Ventures, Urban Innovation Fund, Forward Deployed VC, and Fulcrum Venture Group also participated in the seed round, along with a group of angel investors.

HHS Finalizes Significant Modifications Aligning Part 2 Regulations with HIPAA

On February 16, 2024, the U.S. Department of Health and Human Services (“HHS”) published a final rule (“Final Rule”) in the Federal Register modifying regulations at 42 C.F.R. part 2 (“Part 2”) governing the confidentiality of substance use disorder (“SUD”) records. The changes, which largely finalize those proposed in a notice of proposed rulemaking (“NPRM”), are intended to implement section 3221 of the Coronavirus Aid, Relief, and Economic Security (“CARES”) Act and more closely align Part 2 with privacy rules under the Health Insurance Portability and Accountability Act (“HIPAA”). Ultimately, the much-anticipated Final Rule relaxes some of Part 2’s very stringent requirements, which have historically limited the ability to include SUD data in electronic health information exchange and care coordination efforts. However, there may be more enforcement of Part 2 now that there can be civil enforcement that aligns with HIPAA. Compliance with the Final Rule is required by February 16, 2026.

The Top FCA Developments of 2023

2023 brought many important False Claims Act developments for companies with business involving government funds.  While overall recoveries remained down compared to pre-2022 levels, the total number of settlements and judgments exceeded any prior year.  Those settlements and judgments also highlight areas of particular focus for the Government, including cybersecurity compliance, pandemic fraud, and small business fraud, among others.  Of particular note, 2023 saw the U.S. Supreme Court issue decisions concerning the Government’s authority to dismiss qui tam actions and the critical element of scienter/knowledge that will have wide-reaching impact.  The courts of appeals also issued significant decisions on damages, materiality, and more.  Crowell attorneys discuss these highlights and others in a "Feature Comment" published in The Government Contractor.
