False Claims Act - Civil Cyber Fraud
- Representing a consulting, logistics, and digital services company in civil cyber fraud FCA investigation of alleged failure to comply with cybersecurity controls and requirements to protect controlled unclassified information (CUI).
- Representing Fortune 50 global telecommunications company in civil cyber fraud FCA investigation of alleged failure to comply with cybersecurity provisions in dozens of government contracts.
- Representing large Native-owned government contractor in civil cyber fraud FCA investigation of alleged misrepresentation of cybersecurity self-assessment scores in SPRS.
- Represented prime contractor in civil cyber fraud FCA investigation of supplier’s alleged misrepresentations of compliance with cybersecurity provisions and self-assessment scores in SPRS.
- Represented software company providing cybersecurity products and services across the public sector in civil cyber fraud FCA investigation of alleged failure to adequately protect sensitive information received from government customers.
- Defended large defense contractor against FCA qui tam allegations of noncompliance with DOD cybersecurity requirements, which resulted in the relator’s voluntary dismissal of the matter.
- Defended contractor against civil cyber fraud FCA investigation of alleged false certifications of compliance with various cybersecurity requirements in contracts for administering federal health care programs.
- Conducted large-scale internal investigation for government contractor involving mandatory disclosure and FCA considerations relating to potential noncompliance with cybersecurity requirements.
False Claims Act - Procurement Fraud
- Represented a management consultant and systems engineering contractor in connection with a qui tam action and DOJ investigation of allegedly false statements and/or false claims about the number of hours its employees worked on multiple government contracts, which resulted in DOJ’s declination to intervene and relator’s dismissal of claims.
- Defended VA contractor against FCA allegations of submitting duplicate and inflated claims and achieved a favorable administrative resolution.
- Led internal investigation and developed disclosure strategy relating to company’s failure to perform required conformance testing for products listed on the government’s Qualified Product List. Secured favorable resolution of matter with OIG.
False Claims Act – Litigation
- Represented a drug manufacturer in a qui tam FCA lawsuit involving allegations of fraudulent pharmaceutical testing methods. The case was dismissed. (D.N.J.)
- Represented a general contracting company in a qui tam FCA lawsuit involving allegations of violating SBA’s 8(a) program requirements applicable to set-aside contract awarded by the U.S. Navy. The case resulted in a favorable settlement and release.
Government Investigations
- Successfully led the defense of a whistleblower OSHA investigation into one of the largest healthcare providers in the Midwest, which involved proceedings before the Solicitor General’s Office. OSHA concluded its investigation with no charges.
- Managed response to federal criminal grand jury subpoena involving alleged violation of conflict-of-interest regulations and requirements, which resulted in the DOJ concluding investigation with no charges.
