Overview
In the face of global consolidation, advances in technology, and the development of innovative business models, competition regulators worldwide are increasing their scrutiny of potential anticompetitive activity and transactions that may raise competition concerns. Since the UK’s exit from the EU, the UK Competition and Markets Authority (CMA) has taken a more significant place on the global regulatory stage. Companies are facing challenges resulting from the increasing number of parallel reviews by the CMA and the European Commission and the start of some divergence between UK and EU competition law. At the same time, the CMA is also looking more carefully at all types of arrangements and less easily accepting arguments that they are pro-competitive.
