Brussels and Doha – April 1, 2024: The Legal 500 Europe, Middle East & Africa (EMEA) 2024 edition has recognized 16 practice areas and 11 lawyers in Crowell & Moring’s Brussels and Doha offices. The 11 individual lawyers received 18 total rankings across the 16 different practice areas.

Washington – January 11, 2023: Crowell & Moring has published Litigation Forecast 2023: What Corporate Counsel Need to Know for the Coming Year. The 11th-annual Litigation Forecast focuses on trends in litigation that are playing out in specific jurisdictions around the globe. 

Washington – January 3, 2022: Crowell & Moring elected 13 lawyers to the firm’s partnership, effective January 1, 2022. The firm also promoted seven to the position of senior counsel and 19 associates to the position of counsel. The new partners have been promoted from within the ranks of the firm’s London, New York, and Washington, D.C. offices and from across several practice groups, including Advertising & Media; Antitrust & Competition; Corporate; Energy; Environment & Natural Resources; Government Contracts; Health Care; Technology & Intellectual Property; International Dispute Resolution; Litigation; Mass Tort, Product, and Consumer Litigation; and Privacy & Cybersecurity.

After more than two years of preview and consultation, including thousands of public comments, the Antitrust Division of the Department of Justice and the Federal Trade Commission issued the final version of their 2023 Merger Guidelines (“Guidelines”) yesterday, December 18, 2023. As we noted when the draft guidelines were released in July, the final Guidelines both harken back to older, long-standing precedent and provide a framework for how the Agencies apply merger enforcement policy in modern economic markets. The Guidelines hold fast to the Biden administration’s enforcement policy to address harms from what they perceive to be “excessive” corporate consolidation by reinvigorating and enhancing merger enforcement. Yet, the final Guidelines show that the Agencies have responded to at least some of the criticism of the draft version, and may be more likely to align with how courts currently analyze merger challenges.

On 08 September 2022, the Russian Government issued a Russian Presidential decree which introduced a new vetting procedure regulating situations where “unfriendly” persons take part in transactions involving shareholdings in Russian limited liability companies.  These transactions are now subject to an approval decision by the Government Commission on Control over Foreign Investments before they can be completed.  This is the latest in a growing line of countermeasures being introduced by the Russian President to try to keep liquid assets within Russia and bolster the country’s financial markets.

The U.K.’s new national security regime under the National Security and Investment Act (the “NSI Act”) officially commenced on 4 January 2022. While the U.K. government can review any transactions which completed on or after 12 November 2020 (using its “call-in power”), the mandatory notification requirement only applies to transactions that sign on or after 4 January 2022. Notifications under the NSI Act can now be submitted electronically, using a template notification form.
