Overview

Clients turn to Eric Buhr for his extensive experience in litigating and resolving complex commercial litigation matters. As part of the firm’s Health Care Group, Eric handles a wide range of issues affecting managed care and health insurance companies, including member benefits and bad faith denial of benefits, breach of contract, the Employee Retirement Income Security Act of 1974 (ERISA), and general commercial and indemnity issues.

Eric also has extensive experience in product liability litigation involving the defense of pharmaceutical and medical device companies. He has helped companies manage large complex litigation, including federal multidistrict litigation (MDL), class actions, and coordinated state court proceedings. He has served on many high-profile mass tort trial teams involving products such as hernia mesh, transvaginal mesh, and various pharmaceuticals.

He has also handled general commercial litigation, including alleged violations of state consumer fraud and unfair business practice laws.

  • Represented two surgical technology manufacturers in state coordinated cases and federal multidistrict litigation involving hernia mesh patches, including two bellwether trials.
  • Defended leading U.S. pharmaceutical manufacturer as part of national counsel team in litigation involving injectable type-2 diabetes medication.
  • Represented U.S. multinational pharmaceutical company in a wrongful death trial involving an antipsychotic, which resulted in a defense verdict.
  • Member of national counsel team for pharmaceutical manufacturer defendant in coordinated diet drug litigation.
  • Member of trial team that won total defense verdict on behalf of national prosthetic hip device manufacturer in Los Angeles Superior Court after three weeks of trial in litigation involving recalled product.
  • Defended consumer product manufacturer in tort case involving allegations of peritoneal mesothelioma from asbestos-contaminated talc in cosmetic products.
  • Successfully obtained summary judgment in tenant screening reports/consumer credit reporting ICRAA litigation matter; result upheld on appeal and remaining cases were settled on terms favorable to client.
  • Member of national coordinating counsel team in welding rod litigation. Assisted in the defense workup of thousands of cases for more than 20 distributors sued both in state courts and the MDL.
