Bishop. Representative Matters
- Chair multiple jury trials and arbitrations involving both OON UCR and contractual reimbursement policy disputes on behalf of payors.
- Defend health plan in class action relating to allegations of misclassification of emergency claims by OON physicians.
- Defend health plan against putative class actions alleging improper mid-year modifications to plan contracts to revise member cost-shares, among other terms.
- Defend health plan against allegations of violations of the “reverse” False Claims Act based on alleged underpayment of UCR by OON facility.
- Defend health plans in out of network UCR professional and facilities cases.
- Defend health plan in a narrow network/network exclusion case with alleged damages of over $1.5 billion dollars
- Defend health plan and health insurer in high profile litigation, both class and individual cases, involving the rescission of coverage.
- Defend health plans in complex bad faith, breach of contract, ERISA, and unfair competition cases arising from the denial of benefits and related issues.
- Defend banking client in a putative class action alleging violation of Fair Credit Reporting Act.
- Defend credit issuer in putative class action alleging violations of consumer protection statutes by failing to include late and annual fees in the minimum payment amounts reflected in account statements. Case dismissed before class certification.
