In Aviation Training Consulting, LLC, ASBCA No. 63634 (Jan. 11, 2024), the Armed Services Board of Contract Appeals (ASBCA) confirmed that a contractor’s properly asserted claim for relief under Section 3610 of the Coronavirus Aid, Relief, and Economic Security (CARES) Act is a claim under the Contract Disputes Act (CDA) and denied the Air Force’s motion to dismiss for lack of jurisdiction.

CBCA’s FY 2023 Report – Examining the Numbers

The Civilian Board of Contract Appeals (CBCA) recently published its Annual Report for FY 2023, providing statistics regarding the adjudication of appeals between contractors and civilian agencies such as the Department of State, the Department of Veterans Affairs, the General Services Administration, the Department of Transportation, the Department of Agriculture, the Department of the Interior, and the Central Intelligence Agency. According to this year’s report, contractors prevailed in 45% of the appeals decided on the merits, which is much higher than the 21% success rate in 2022. The report also shows that the CBCA’s alternative dispute resolution (ADR) program remains successful—resolving 70% of appeals for which the parties completed ADR. All of this came in the context of a substantial jump in the number of appeals, with 246 new appeals docketed in 2023 compared to 177 in 2022 and 185 in 2021. Click here to view the full CBCA report.

Board “Evicts” Government Termination: Contractor Awarded Expected Lost Profits for Improper Lease Termination

In Flatland Realty, LLC, ASBCA No. 63409, the Armed Services Board of Contract Appeals (Board) granted an appeal seeking damages, plus interest, from an improper termination for default.  In an uncommon result, the Board awarded lost profit expectancy damages because the government had improperly terminated the contract, which did not incorporate a termination for convenience clause.

COVID-19 Claims and Requests for Equitable Adjustment Q&A Webinar — “Tick Tock – Submitting COVID-19 Related Claims and REAs as the Government Fiscal Year Draws to a Close”

For nearly 6 months, the Coronavirus pandemic has caused disruptions across nearly all industrial sectors, including the government contracting industry.  As contractors have attempted to respond to challenges in providing support to government customers, meeting contract and staffing requirements, and adhering to contract terms and a constantly shifting landscape, Congress provided an additional avenue of relief to certain contractors dealing with COVID-19 related impacts.  Section 3610 of the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) provided assistance in connection with certain disruptions in contractor performance arising from the COVID-19 pandemic.  Now, as the Government fiscal year draws to a close, many contractors are considering whether and when to submit potential Claims and REAs – including Claims and REAs triggered in part by COVID-19 related issues – and how best to position themselves to recover schedule and cost impacts triggered by COVID and non-COVID related causes.
