Over the past eight years, the Obama Administration has pursued its labor and employment law priorities through a series of Executive Orders, administrative rule-makings, and enhanced enforcement efforts. Throughout this time period, the Department of Labor has been elevated to a “front row” agency, leading the charge on several of President Obama’s key priorities, from pay equity to increasing the universe of employees eligible for overtime. As the new Trump Administration continues to take shape and as courts assess the legality of some of President Obama’s signature initiatives, a primary open issue for employers centers upon which of the Obama initiatives will survive in 2017. Our Labor & Employment team, together with colleagues from our Government Contracts group, will discuss the likely regulatory and enforcement landscape as the Department of Labor (DOL), National Labor Relations Board (NLRB), and Equal Employment Opportunity Commission (EEOC) move into the new year.
