Part 2 – For Other-than-Small Businesses: Recent and Coming Changes to Key Small Business Rules and Regulations

Crowell & Moring is offering a two-part webinar series for government contractors on past and anticipated developments in procurement statues and regulations concerning small businesses.
The federal procurement system provides benefits for small and disadvantaged businesses, such as the ability to compete for set-aside procurements, receive sole-source awards, and access assistance through such programs as the 8(a) Business Development Program or the Small Business Administration’s (SBA) Mentor-Protégé Program. The statutes and complex rules and regulations governing this system have recently undergone many important changes—as Crowell has previously addressed in blog posts covering SBA’s rulemaking on the consolidation of its mentor-protégé programs and the SBA Rule implementing a one-year extension for 8(a) BD status—with more changes anticipated this year as required by the National Defense Authorization Act for Fiscal Year 2021.
Crowell is offering two webinars for different target audiences in which we will discuss the same recent and coming changes—but one will be crafted for small businesses and one for other-than-small contractors.
The second webinar is for any other-than-small businesses who interact with small businesses within the federal procurement system—whether as a mentor, joint venture member, prime contractor reporting small business spend against a small business subcontracting plan, subcontractor to a small business under a set-aside award, and/or an acquirer of a business that holds set-aside contracts. Crowell will provide practical advice about how the recent and coming changes to the small business rules and regulations impact these types of other-than-small contractors. We will address the compliance risks faced that other-than-small contractors face in this space and how government agencies and relators have increasingly focused False Claims Act and enforcement efforts for violations of small business rules at other-than-small contractors.

Bar Administrative Law and Agency Practice Community for a discussion of the key takeaways from the Supreme Court's 2025-26 term. This panel will examine decisions addressing the scope of executive branch authority, including cases involving tariffs issued under the International Emergency Economic Powers Act and the removal of leaders of so-called independent agencies. The discussion will also address significant orders issued on the Court's emergency docket and what these decisions and orders signal about the distinct roles the three branches of federal government play in shaping the administrative state.
