Federal Wage and Hour Law: Developments under the New Administration

Our next Third Thursday program features a roundtable discussion of what to expect in federal wage hour law as the new administration and its new Secretary of Labor get settled in.
Secretary of Labor Alexander Acosta was confirmed by the Senate last week, and a new DOL leadership team is being assembled. As they move forward, we can expect them to confront a variety of pending wage hour issues affecting companies of all sizes. One of these issues will be what to do with the regulations that DOL issued last year raising the salary threshold for defining who’s exempt under the FLSA’s “white collar” exemptions. Another will be how DOL’s new personnel will approach the agency’s approach to audits, investigations and litigation.
Our panel will also discuss wage hour developments pending in Congress (including this week’s spending bill and the “comp time” bill under consideration) and in the courts, including the class action waiver and mandatory arbitration cases pending before United States Supreme Court. We will also review recent case law regarding the certification of collective actions and the application of the FLSA’s white collar exemptions.
