Federal Consumer Protection Turns Blue
Webinar | 02.24.21, 7:00 AM EST - 8:00 AM EST
The balance of power at the FTC, FCC and CFPB is shifting with the new administration. This may bring different consumer protection enforcement priorities. In this seminar, we will offer predictions about what to expect in the next two years as these changes take place. Panelists will discuss:
- How will the new democratic majority at the FTC alter consumer protection enforcement priorities and strategies, if at all? What might a Supreme Court ruling striking down the FTC restitution policies under Section 13(b) mean to agency enforcement?
- Will privacy and data security again dominate the FTC agenda? If so, what can we expect?
- Will the FCC turn 180 degrees yet again by reinstituting net neutrality? Can it? And, if so, what might that mean for the Internet?
- Will the CFPB roar back to life with new and aggressive enforcement in the consumer financial arena?

The federal government has identified purported ‘waste, fraud, and abuse’ in small business programs as a major focus of its current enforcement efforts. As it relates to federal procurement, we have seen audits and investigations rolled out not only of active participants in the Small Business Administration’s 8(a) Business Development Program but also reviews of various types of small business contracts (such as 8(a) sole source and set-aside awards, preference-based awards, and small business set-aside awards over particular values). Join Crowell & Moring as we discuss what aspects of contract performance and teaming arrangements are being scrutinized (e.g., size/status eligibility, limitations on subcontracting compliance, reasonableness of market rates, etc.) and how these considerations can impact both small government contractors holding the prime contracts under review and their subcontractors.
