Theft of company data by departing employees is a growing concern for employers. The current dispute between Google and Uber over alleged theft of self-driving vehicle technology followed Uber’s decision to hire former Waymo employee Anthony Lewandowski. This litigation is the most recent, high profile example of how these concerns can play out in court.
Our panelists include Labor & Employment attorneys, as well as Anne Herold Li, from Crowell & Moring’s intellectual property litigation group, who specializes in trade secrets protection advice and related litigation. We will discuss best practices for responding to departing employees who are privy to confidential and proprietary company information. Using the Google-Uber litigation as a case study, we’ll discuss a variety of issues, including topics to consider in drafting enforceable agreements and effective utilization of exit interviews and other HR practices designed to protect company data.
