States Are Leading the Way on AI Safety Regulation

On September 28, 2026, partner Matthew F. Ferraro published an article with Dow Jones Risk Journal, “States Are Leading the Way on AI Safety Regulation.”

In the article, Mr. Ferraro – who counsels clients widely on the regulation of artificial intelligence – explained that California, New York, and Illinois are creating a de facto national framework for frontier AI safety as Congress debates federal legislation. The state laws broadly align on safety frameworks, transparency disclosures, and critical-incident reporting, with a few variances related to AI auditing requirements. He concludes that AI developers should build an integrated nationwide compliance program now while preparing for potential federal legislation that could seek to preempt state requirements.
