Orlando Federal Court Denies Petition of Former Death Row Inmate Crosley Green

Washington, D.C. – January 22, 2016: The federal court in Orlando, Fla., has denied former death row inmate Crosley Green's petition for a writ of habeas corpus, seeking to overturn Mr. Green's conviction or granting him a new trial based on evidence of innocence.  

"We are deeply disappointed with the court's decision," said Crowell & Moring partner Keith J. Harrison, lead attorney for Mr. Green. "We believe that the district court's decision is contrary to the law and, in particular, that evidence in Mr. Green's case meets all of the standards for actual innocence that have been established by law. We will continue our effort to obtain justice on behalf of Mr. Green's through all available means."

On September 5, 1990, an all-white jury convicted Mr. Green of first-degree murder of a 22-year-old man in Titusville, Florida and sentenced him to death. In Mr. Green's state habeas proceedings, the Supreme Court of Florida let stand Mr. Green's murder conviction but granted a new penalty phase hearing finding that trial counsel was ineffective.

The ABA Death Penalty Project referred Mr. Green's case to Crowell & Moring. In 2009, Mr. Green was removed from death row.

Based on evidence discovered during Crowell & Moring's investigation, Mr. Green petitioned the federal court for the Middle District of Florida for a writ of habeas corpus seeking a new trial due to constitutional violations in his original state trial, all of which point to the fact that he is actually innocent of the crime for which he was convicted.
