Crowell Secures Victory for Mondelēz in False Advertising Alleged “Greenwashing” Suit

Chicago – October 29, 2025: Crowell & Moring secured a complete dismissal with prejudice of a proposed class action suit on behalf of Mondelēz, LLC in the Northern District of Illinois.
The suit alleged that Mondelēz misled customers into believing its Clif Kid Zbars are produced without causing pollution as the bars state the product is “climate neutral certified.” That designation is provided by a third-party organization, the Change Climate Project.
Adopting the position put forth by Mondelēz, U.S. District Judge Manish Shah ruled that there is a distinction between advertising a product as climate neutral and advertising it as climate neutral certified. Finding that consumers are not “permitted to defy common sense and everyday experiences,” the Court concluded that there was “nothing deceptive about Mondelēz including on its packaging a true statement."
