Crowell & Moring Counsel to Moderate Homeland Security Panel at ABA Administrative Law Conference

Washington, D.C. – October 21, 2003: Crowell & Moring LLP is pleased to announce that Thomas Newton Bolling, counsel in the firm's Aviation Practice, has been named one of the moderators of the 2003 Administrative Law Conference of the American Bar Association to be held November 6-7, 2003, in Washington, D.C. Mr. Bolling will moderate presentations and panel discussions on "Significant Administrative Law Issues in Homeland and National Security" at 1:45-4:00 p.m. on November 7, 2003, at the New Washington Convention Center. The panel will also include Francine Kerner, Chief Counsel of the Transportation Security Administration; Norman Abrams, Interim Dean and Professor at UCLA Law School; Sally Katzen, Professor at the University of Michigan Law School, former Deputy Director of the Office of Management and Budget and former Administrator of OMB's Office of Information and Regulatory Policy; Stephen Legomsky, Professor at Washington University Law School; and Peter Raven-Hansen, Professor at George Washington University Law School.

Justice Sandra Day O'Connor of the U.S. Supreme Court will make special opening remarks during the afternoon panels on November 7.

The Administrative Law Conference of the ABA is an annual continuing legal education symposium in Washington, D.C., that reviews the most significant developments of the past year in administrative law and regulatory practice. The panel "Significant Administrative Law Issues in Homeland and National Security" will review administrative and regulatory law issues including the Transportation Security Administration's current responsibilities and administrative process; consequences of the widespread use of interim rulemaking and the unfunded mandates of Homeland Security's approach to the Administrative Procedure Act; administrative law issues concerning nuclear power regulations; administrative process concerning executive branch designation of an organization as a "foreign terrorist organization" and then using this as the basis for prosecuting individuals who provide material support to such organizations; history and current controversy over closed detention proceedings and other immigration problems post-9/11; and a review of several published notices since March 2002 pertaining to military commissions and the likelihood of their use as the war on terrorism increases. Mr. Bolling is Chair of the Transportation Committee of the ABA's Section of Administrative Law and Regulatory Practice and helped to plan the panel with Program Chair Lynne Zusman, a Washington attorney in private practice who is Chair of the Section's Homeland Security Committee, and co-moderator Michael Fitzpatrick, another Washington attorney in private practice.

Mr. Bolling advises airlines, trade associations and aviation manufacturers on federal laws, regulations and rulemakings affecting the aviation industry and legislative and regulatory developments in the nation's capital. He also practices in homeland security and hazardous materials transportation law. In addition to Mr. Bolling's ABA responsibilities, he is Program Co-Chair of the Transportation Law Institute.
