Ann R. Klee Testifies at U.S. Senate Environment & Public Works Committee Hearing on U.S. Supreme Court's Decision in Massachusetts v. EPA

Washington, D.C. – April 24, 2007: Ann R. Klee, Environment & Natural Resources partner with Crowell & Moring LLP and former General Counsel of the Environmental Protection Agency, testified at the U.S. Senate Committee on Environment & Public Works hearing, “The Implications of the Supreme Court’s Decision Regarding EPA’s Authorities with Respect to Greenhouse Gases under the Clean Air Act.” The hearing, chaired by Sen. Barbara Boxer (D.-Calif.), occurred Tuesday, April 23, 2007 at 9:45 a.m. EDT. Klee sat on a witness panel that examined actions EPA could take in the wake of the Supreme Court’s decision in Massachusetts v. EPA.
Klee was joined on the panel with: Stephen L. Johnson, EPA Administrator; William K. Reilly, former EPA Administrator; Carol M. Browner, former EPA Administrator; Peter Glaser, Clean Air attorney and partner at Troutman Sanders, LLP; and David Doniger, policy director of the Natural Resource Defense Council’s Climate Center.

As a partner at Crowell & Moring, Klee provides counseling, litigation and legislative representation to a wide range of companies, trade associations, and state and local governments. She held the position of General Counsel of the EPA for two years following her appointment by President George W. Bush in May 2004 and confirmation by the U.S. Senate. She is also the former Chief Counsel of the U.S. Senate Committee on the Environment and Public Works and served as the Counselor to the Secretary of the Department of the Interior (DOI). While at EPA, her work included serving as the agency lead on numerous Supreme Court and federal court briefs, including two landmark decisions concerning wetland protection under the Clean Water Act as well as developing immediate guidance on novel legal issues to facilitate post-Hurricane Katrina and Rita clean-up. Her work also included supervising the legal implementation of the Clean Air Mercury Rule and the Clean Air Interstate Rule; developing agency legal opinions regarding water transfers and application of pesticides to U.S. waters; and review of legal issues relating to permitting of energy development projects, including oil and gas leases, liquid natural gas facilities, and power plant licensing.
