Mark A. Klapow is a litigator who helps clients address their most important legal challenges through a results-oriented approach focused on efficiency and service. He litigates intellectual property, antitrust, and other complex commercial cases.

Recent engagements include Alcoa, AT&T, Dow Corning, Ericsson, ExxonMobil, and a Fortune 100 financial services company.

Mark is the leader of the firm's Trade Secrets Practice, an area in which he litigates, speaks, and writes. He is also co-editor of the firm's Trade Secrets Trends blog.

Mark is the creator and editor of the firm's annual Litigation Forecast, the guide for in-house counsel managing litigation in the coming year.

Mark also serves as outside general counsel for the Hispanic Heritage Foundation and Adat Shalom.

He and his wife live in Somerset with their four children.

Representative Matters

  • TCL v. Ericsson (2016). Represent Ericsson in first of its kind lawsuit alleging breach of FRAND licensing commitment on standard essential telecommunications patents. Pending in California federal court.

  • Matrix Markets et al. v. NEO Markets et al. (2016). Lead counsel in trade secret and commercial dispute. Won two TROs and defeated two TROs in span of five weeks. Pending in Texas state court.

  • Hyperlync Technologies v. Verizon et al. (2016). Lead counsel in trade secret and breach of contract dispute. Defeated motion to dismiss. Pending in New York State court.

  • Hemlock Semiconductor v. Summit Design et al. (2015). Lead counsel for Hemlock in trade secret theft case related to top secret manufacturing processes. Won TRO and preliminary injunction in Tennessee federal court.

  • Woebel v. INTL FCStone et al. (2015). Co-lead counsel for Fortune 100 financial services company in putative securities class action.  Won dismissal in New York federal court.

  • INTL FCStone et al. v. Ortiz (2014). Lead counsel for Fortune 100 company in non-compete and trade secret theft case against executive who joined key competitor. Won preliminary injunction in Illinois state court.

  • Dow Corning v. NuSil Technology (2013). Lead counsel for Dow Corning in trade secret case against competitor. Won TRO in Michigan state court and, after full day PI hearing, favorable settlement dismissing case and related California federal case.

  • Metroil Inc. v. ExxonMobil et al. (2012). Lead counsel for ExxonMobil in test case and two follow-on cases under federal law and state law issue of first impression. Won dismissal in D.C. federal court. Argued and won appeal in D.C. Circuit.

  • U.S. v. AT&T (2011). Represented AT&T in case brought by the United States and several states in D.C. federal court to prevent proposed merger with T-Mobile. Case dismissed and merger abandoned after FCC opposition.

  • Santiago Sepulveda, et al. v. Esso Standard Oil Co. (2011). Argued and won appeal for ExxonMobil subsidiary in First Circuit in consolidated cases against more than 100 dealers opposing sale of station assets in Puerto Rico.

  • Anheuser-Busch v. Afa Dispensing Group, et al. (2010). Represented A-B in a supplier dispute relating to a highly sensitive product in development. A-B's request for TRO based on misappropriation of trade secrets and violation of non-compete clause was granted in Missouri federal court. Supplier's parallel request for TRO and injunction to require continued performance was denied after hearing in a New York federal court.

  • Miller UK ltd. V. Caterpillar (2010). Represented Caterpillar in supplier dispute alleging trade secret theft in Illinois federal court.
