Overview

Dan Campbell has over 25 years of experience representing clients in their biggest litigations and guiding clients through their most significant disputes, working with corporations and organizations facing product liability, commercial, or contractual disputes throughout the United States. In product matters, Dan serves as national coordinating counsel, strategic counsel, and lead trial counsel for companies of all sizes on product liability, warranty, and other personal injury and property damage claims. His tort and product liability experience spans various industries, including automotive, medical device, railroad, and aviation, and his clients include product manufacturers, distributors and retailers. Dan litigates complex insurance coverage disputes, as well as complex contract, commercial litigation and arbitration matters for product manufacturers, service providers, and government contractors.

Dan is ready, and always excited, to take a case through trial. He has first chaired over 30 jury trials to verdict in state and federal courts. In addition to representing companies in their most significant litigations throughout his career, he has also counseled consumer product and automotive industry manufacturers and suppliers in regulatory compliance, recall reporting obligations, pre-litigation strategies and other issues, such as product risk assessment, design and testing strategy, and warning language.

For the past several years Dan co-chaired the firm’s Mass Tort, Product, and Consumer Litigation Group. Dan serves on the Firm’s Talent Development Committee, which assists in formulating policies on associate/counsel development and compensation issues. He is also the immediate-past chair of the firm’s Lawyer Development Committee, where he was responsible for overseeing the review and development process for all of the firm’s associates and counsel. Dan has also been an instructor for Crowell & Moring's Trial Advocacy program since its inception almost 15 years ago. In this program, Crowell & Moring associates and counsel receive on-their feet training and instruction on various trial elements and skills. The program culminates with mock trials held in the D.C. federal courthouse.

Dan began his career in Norfolk, Virginia, where he represented Fortune 500 companies and smaller organizations in defense of product liability, medical device, premises liability, toxic tort, and railroad FELA claims, as well as on commercial litigation matters. He also represented physicians and other health care providers in defense of medical malpractice claims, and nursing home facilities in defense of negligence claims.

Earlier in his career, Dan was the statewide coordinator and chair of the Virginia Bar Association Young Lawyers' Division Model Judiciary Program, which provides an opportunity for high school students to participate in mock trials and mock appeals before real judges, including appellate arguments to the Justices of the Supreme Court of Virginia. Dan also served on the Executive Committee of the VBA YLD.

Representative Matters

Pharmaceutical Litigation

  • Serving as lead counsel for a Fortune 20 company in one of the largest pharmaceutical Multi-District Litigations (MDLs) in the country, involving three class actions and over 1,000 individual suits, defending claims of adulteration in certain generic prescription medications.
  • Served as lead counsel for a pharmaceutical re-packager in multi-case litigation in state and federal courts, defending product defect claims involving certain over the counter medicine.

Insurance

  • Representing a leading insurance company in defending a complex coverage case involving environmental claims by a pulp and paper mill.
  • Represented a specialty aircraft insurance company in coverage litigation involving damage to an airplane from an emergency landing in Somalia.

National Coordinating Counsel

  • Managing as lead counsel the defense of hundreds of toxic tort matters pending in over 20 jurisdictions, state and federal, for a prominent defendant, ensuring the coordination of trial and defense themes, expert witness strategy, motions strategy and discovery, managing local counsel and preparing witnesses for trial and deposition purposes.

Automotive & Transportation

  • Represented one of the world's leading Tier 1 parts suppliers in a billion-dollar dispute over alleged product defect and warranty claims, in which Dan helped guide the client to a favorable resolution of the dispute prior to litigation.
  • Represented one of the nation's leading transportation companies, providing rail-based transportation services, regarding complex contract and tort issues related to a significant bridge collapse and train derailment, obtaining a low dollar settlement on significant property damage claims.
  • Lead counsel for automotive parts manufacturers in regulatory compliance and recall issues, including filing recalls with NHTSA and interacting with the agency through the life of the recall.

Food Litigation

  • Served as lead counsel defending one of the nation’s leading snack food manufacturers in breach of contract and promissory estoppel claims filed in Illinois federal court, obtaining summary judgment on all claims prior to trial.

Jury Trials

  • First chaired the defense of a national wheelchair distributor in a federal court trial involving claims of product defect allegedly resulting in severe brain injuries, winning a defense verdict.
  • Defended one of the nation's leading amusement park owners in a federal court trial involving claims of ride design defect allegedly resulting in severe permanent injuries, winning a defense verdict.
  • First chaired the defense of a surgeon in a state court trial involving claims of medical malpractice, winning a defense verdict.
