I Don't Like ICANN's Decision Regarding .Why, But Now .What?

Throughout the course of the next year, ICANN will be making decisions regarding the online future of literally hundreds, if not thousands, of companies. As these decisions become public, companies will experience, perhaps for the first time, the reality of an unfavorable decision made by ICANN, a hybrid international organization with plenary authority but without traditional regulatory restrictions, private-sector competition, or shareholder accountability. And as a result of the unique composition, status, and role of ICANN, some of the more familiar avenues of redress for companies involved in commercial disputes or bid protests will be more limited and certainly require a nuanced approach to be successful. We will discuss several big picture considerations for companies forced to deal with ICANN’s potentially inconsistent and arbitrary decisions.
