Government Contractor Defense--Vulnerable to Attack

For over 22 years, the government contractor defense as enumerated in the landmark case of Boyle v. UTC has provided an effective shield from many product liability claims for companies that design and manufacture aerospace products for the US military.

In recent years, however, trends have developed that raise questions as to the future direction of the defense.

Going forward, will the defense be as effective, considering the growth of technology; increased service contracting; commercialization of federal procurement practices; and the role of outsourcing? On the other hand, could the defense be strengthened by currently-proposed acquisition reforms designed to increase government oversight and control?
