Overview

Financial institutions participating in the market for troubled and nonperforming loans and claims look to James Ohlig to provide experienced guidance and insight with respect to trading structure and documentation as they relate to the allocation of credit risk in the fixed-income trading markets.

Jim is a recognized authority on global bank loan and claims trading matters. For more than two decades, he has represented global investment banks, CLO managers, hedge funds, and other financial institutions in primary and secondary bank loan, high-yield debt, and bankruptcy and litigation claims trading.

Jim regularly advises clients that originate, restructure, and trade commercial and industrial bank loans, distressed securities, claims arising from bankruptcy or other litigation proceedings, and any related obligations. Both buy-side and market-making broker-dealer clients seek counsel from Jim in understanding primary and secondary market standards, conventions, practices, and documentation for trading liquid and illiquid par and distressed bank loans and claims in the U.S. and international trading markets.

Jim specializes in the preparation and negotiation of primary and secondary market loan and claims trading documentation, including agreements adopted under the Loan Syndications and Trading Association, Inc. (LSTA), and Loan Market Association regimes and other bespoke purchase and sale contracts as well as secondary market private securities trading documentation. Jim has also been engaged by investors seeking to acquire strategic positions in companies undergoing financial restructuring or in bankruptcy, and he often advises these clients in reviewing and analyzing credit documentation and related reorganization or bankruptcy materials.

James is an active participant in the LSTA and sits on numerous LSTA committees.

Prior to joining the firm, he was counsel with Kibbe & Orbe LLP.
