Overview

The Trump Administration has made it clear that it believes that tariffs are necessary to protect the economic and national security interests of the U.S. As such, there are other legal avenues open to the President that are already being used to impose further import restrictions, including temporary tariffs under Section 122, unfair trade practice tariffs under Section 301, and national security tariffs under Section 232. Crowell has worked with key government agencies and obtained hundreds of product exclusions from tariffs resulting in hundreds of millions of dollars of duty refunds and savings. We have also worked with clients to mitigate tariffs through our extensive knowledge of customs laws, including Harmonized System reclassification (tariff engineering), valuation (first sale and other), origin (USMCA, FTA, and supply chain modifications), drawback, FTZ, and special chapter 98 duty savings provisions (U.S. content, goods returned, Nairobi protocol, protypes, sample, government and temporary imports).
