Overview

Scott Williams’ practice focuses on managed care litigation and counseling. A member of Crowell’s Health Care Practice, Scott has broad experience in representing managed care companies in litigation and arbitration matters across the country, including in suits challenging reimbursement, claims processing, benefit interpretation, HIPAA requirements, Employee Retirement Income Security Act (ERISA) requirements, fraud, breach of contract, and state deceptive trade practices claims. Scott regularly presents on ethical issues faced by managed care organizations and advises on each state’s approach to attorney-client privilege.

Prior to joining Crowell, Scott served as the Senior Associate General Counsel at Health Care Service Corporation (HCSC), managing litigation matters across the enterprise, which includes Blue Cross and Blue Shield affiliates in Texas, Oklahoma, Illinois, New Mexico, and Montana, as well as Dearborn National Life insurance company.

While at HCSC, Scott's areas of practice included health insurance, ERISA, Medicare Advantage, RICO, contracts, False Claims Act (FCA), and liability insurance coverage disputes in state and federal court and in arbitration. In addition, at HCSC, Scott was recognized for Significant Results in Support of Litigation. He also created the Texas legal pro bono program, which included organizing staffing of the Dallas Veteran's Legal Clinic.

Prior to working for HCSC, Scott was a partner at a global law firm in Dallas. His practice included representing business in complex commercial litigation and appeals, with an emphasis on class action defense, business torts, fraud actions, commercial contract disputes, and intellectual property disputes. In addition, he had broad experience in representing business entities in government investigations and enforcement actions, including those brought by the SEC, and state agencies and attorneys general, and in advising investment funds, private equity funds, and corporate boards on rights and obligations to investors and counterparties.

He garnered significant first-chair litigation experience, including multiple trials and arbitrations in Dallas, New York, and Miami, and appellate arguments in Texas appellate courts. He also represented clients in commercial cases in a wide range of industries, including telecommunications, investment funds, private equity, financial services, commercial mortgages, heavy manufacturing, commercial goods, oil and gas, nutritional supplements, aerospace, chemical manufacturing, and travel services.

  • Presented argument at the Dallas Court of Appeals and obtained a complete reversal of all damages awarded at trial on behalf of an aircraft owner in a case related to ownership of thrust reverser on a 757 aircraft.
  • Obtained reversal on appeal of class certification on behalf of a commercial mortgage servicer in a case with industrywide implications related to force-placed "terrorism insurance" after September 11, 2001.
  • Obtained multimillion dollar arbitration award on behalf of investment fund related to the failed interior completion of a private aircraft.
  • Obtained complete dismissal of two putative worldwide class actions brought on behalf of travel agents against a commission processing service related to mass enrollment of agents in the company's commission processing program.
