Representative Matters
- Representing insurers and claims administrators in series of litigation and arbitrations involving claims for out-of-network emergency services.
- Representing health insurers, claims administrator, and self-funded health and welfare plans in ERISA litigation related to coverage for behavioral health services and claims for alleged violations of the Mental Health Parity and Addiction Equity Act (MHPAEA).
- Providing litigation defense, support to internal SIU/fraud investigations, and counseling on issues related to fraudulent claims/billing for COVID-19 testing services.
- Represented health insurer in litigation brought by out of network provider of applied behavioral analysis (ABA) and autism treatment services to children. Case involved fraud investigation of improper diagnoses and billing practice by provider, including underlying state and federal charges against the provider.
- Represented Medicare Advantage Plan in dispute with provider of risk adjustment services.
- Represented health insurers in series of cases in Pennsylvania, Maryland, and Florida brought by specialty pharmacies and members claiming delay/denial of (and conspiracy to delay/deny) coverage and payment for factor VIII medication. Claims asserted include violations of ERISA, antitrust, civil conspiracy, and violation of state prompt pay statutes.
- Represented health insurer in action alleging claims for bad faith, breach of contract, unfair trade practices, and infliction of emotional distress, arising out of the denial of coverage for an experimental/investigational treatment.
- Represented health insurers in litigation brought by out of network substance abuse treatment providers seeking payment of full billed charges; included fraud investigation, cooperation with federal authorities, and counterclaims for recoupment of overpayments and alleged fraudulent billing practices by providers.
- Represented Medicaid MCOs in Pennsylvania state court litigation (including one class action) brought by out of network emergency transportation companies challenging reimbursement and seeking full billed charges.
