Overview

Jordan devotes his practice to managed care litigation. With his English background and passion for storytelling, clients regularly depend on Jordan to shape and vivify their case narratives to effectively represent them in courts and arbitrations.

Jordan has defended managed care organizations in a wide range of litigation matters. These encompass out-of-network pricing disputes, provider contracting disputes, member and provider suits arising under the Employee Retirement Income Security Act (ERISA), cases related to the Mental Health Parity and Addiction Equity Act (MHPAEA), and other statutory claims. Jordan’s comprehensive experience extends to both state and federal courts as well as alternative dispute resolution forums.

Most commonly, Jordan has coordinated teams to effectively defend managed care companies in complex payment disputes involving a high volume of claims—developing a strong and curated factual record, molding a persuasive legal framework, and building a moving and truthful story. He has significant experience representing clients during depositions, hearings, and at final hearing, ensuring their interests are vigorously safeguarded. He also counsels clients on best practices to mitigate risk and to ensure their corporate policies and procedures are compliant with best practices and industry standards.

Representative Matters

  • Represented managed care organization in breach of contract dispute involving diagnosis-related group (DRG) coding issues and high volume of claims.
  • Defended managed care organization in high-stakes breach of contract dispute involving itemized bill review.
  • Represented health plan in thousands of IDR proceedings under the No Surprises Act, coordinating a team of staff attorneys, paralegals, and other professionals to efficiently manage this docket.
  • Represented health plan in defending arbitration involving Medicaid and Medicare Advantage claims.
  • Defending and counseling managed care organization in payment dispute involving medical coding, policy, and contracting issues in the home infusion therapy industry.
  • Successfully obtained dismissal of payor in member suit brought under ERISA. Case dismissed outright by plaintiffs’ counsel following motion practice.
