Overview

Bryan Webster is a partner in Crowell & Moring’s Health Care Group in the firm’s Chicago office. Bryan focuses his practice on representing corporate clients in highly regulated industries and regulatory investigations. He has extensive experience in representing managed care organizations, third-party administrators, and pharmacy benefit managers in a broad range of individual and nationwide class action suits, including suits challenging provider contracting, network management, claims processing, benefit interpretations, and payment practices involving Employee Retirement Income Security Act (ERISA), Racketeer Influenced and Corrupt Organizations (RICO), fraud, breach of contract, and unfair trade practices claims.

Bryan also frequently counsels corporate health care clients on best practices to mitigate litigation risk and in the creation and implementation of policies and procedures to enhance legal compliance programs. He has counseled leading U.S. insurance companies, Fortune 500 health care companies, and a world-renowned medical center on an array of issues, including medical software licensing agreements, administrative service agreements, state licensing requirements, network management, data privacy, overpayment recoveries, clinical drug trials, commercial agreements with pharmaceutical drug manufacturers, and the creation of multimillion-dollar captive insurance policies.

As a result of his strong track record in efficiently managing numerous high-stakes litigation matters for his clients and providing counseling on best practices for minimizing litigation risk, Bryan has saved his clients millions of dollars in claims, legal fees, and costs.

Bryan further dedicates a significant portion of his time to pro bono efforts, in which he handles difficult cases for low-income clients and nonprofit organizations. He previously served as a court-appointed guardian ad litem for two minors.

  • Represented a managed care organization in a matter involving novel issues regarding reimbursement of emergency services under the Affordable Care Act (ACA).
  • Defended managed care organization in putative class action involving a spinal surgery coverage denial. Case dismissed outright by plaintiff’s counsel following motion practice.
  • Pa. Chiropractic Association v. Blue Cross Blue Shield Association: Successfully defeated an attempt by a group of health care providers to certify a nationwide class of all health care providers against dozens of Blue Cross and Blue Shield insurers regarding claims that the defendants violated ERISA when they allegedly failed to provide ERISA-mandated notice and appeal procedures in recovering overpayments.
  • Westside EKG Associates v. Blue Cross and Blue Shield of Florida, Inc.: Successfully defeated a hospital-based provider group's attempt to represent a class of Florida health care providers for alleged violations of Florida's prompt payment statute, and to recover damages on behalf of those providers for almost every medical claim submitted over a 14-year period.
  • Collins v. Health Care Service Corporation: Successfully defeated the attempt of three health care providers to enjoin a health insurer from terminating the providers from its provider network, and helped develop additional policies and procedures for the insurer to fend off future challenges to the management of its provider network.
  • Solomon v. Blue Cross and Blue Shield Association, et al.: Achieved dismissal with prejudice of a complaint against several Blue Cross and Blue Shield insurers in a national class action filed in a Florida federal court by non-physician medical providers alleging that the defendant health plans conspired to deny reimbursement for medically necessary services rendered by the providers to the health plans' insureds.
  • Trustmark Ins. Co. v. John Hancock Life Ins. Co. (USA): Obtained a federal appellate court reversal of a preliminary injunction barring John Hancock Life Insurance Company (USA) from proceeding with its chosen arbitrator in an ongoing arbitration regarding a decade-long dispute over allocation of millions of dollars in losses pursuant to reinsurance agreements between the two parties, and subsequently compelled the opposing party to complete the parties' arbitration.
  • Ochs v. Dairy Farmers of America, Inc.: Obtained an early complete dismissal of a consumer fraud and antitrust class action filed against one of the world's largest dairy cooperatives in a Kansas state court alleging attempted manipulation of the Chicago Mercantile Exchange's Cheese Spot Call, and seeking millions in purported damages.
  • TAL Apparel Limited v. Esquel Apparel: Invalidated a competitor's patent involving wrinkle-free shirts, and obtained a multimillion-dollar fee award on behalf of one of the world's leading textile manufacturers.
  • Biomet, Inc. v. Bonutti Skeletal Innovations LLC: Secured a favorable settlement for a global orthopedic implant manufacturer accused of marketing more than 15 products infringing 16 patents held by a non-practicing entity following multi-year litigation in two separate forums.
  • Nicor v. S & S Electric: Obtained a complete verdict on behalf of a corporate client following a two-day jury trial regarding damage to its property resulting from a contractor's negligence.
