FAA Invites Fresh Input on Expansive Drone Rule

On January 28, 2026, the Federal Aviation Administration (FAA) announced that it would reopen the comment period for the Notice of Proposed Rulemaking (NPRM) titled “Normalizing Unmanned Aircraft Systems Beyond Visual Line of Sight Operations” for fourteen days. This NPRM, jointly published with the Transportation Security Administration (TSA) on August 7, 2025, introduces performance-based regulations for beyond visual line of sight (BVLOS) unmanned aircraft systems (UAS) operations and the third-party services that support them. Although the NPRM’s initial comment period closed on October 6, 2025, the FAA is now accepting additional feedback through February 11, 2026, with a particular focus on the proposed rule’s right-of-way and detect-and-avoid requirements. The FAA previously rejected formal requests to extend the initial comment period, citing the deadline imposed by Executive Order 14307.

Securing the Skies: Landmark Proposed Rule Contains New Security Requirements for Expanded Commercial Drone Deployments

The Transportation Security Administration (TSA) recently proposed an expanded role regulating unmanned aircraft systems (UAS), or drones.  On August 7, 2025, the Federal Aviation Administration (FAA) and TSA published a joint Notice of Proposed Rulemaking (proposed rule), titled Normalizing Unmanned Aircraft Systems Beyond Visual Line of Sight Operations (BVLOS).  Through this landmark proposed rule, the FAA and TSA aim to provide industry with a clear path forward for streamlined UAS operations for a variety of purposes, including package delivery, agriculture, aerial surveying, civic interest (public safety), and flight testing.  Comments on the proposed rule are due October 6, 2025.

Supreme Court Emphasizes Agency Deference in NEPA Review

On May 29, 2025, the Supreme Court issued its long-awaited decision in Seven County Infrastructure Coalition v. Eagle County. In a five-justice majority opinion written by Justice Kavanaugh, the Court held that the National Environmental Policy Act (“NEPA”) does not require review of the environmental impacts of “upstream” or “downstream” related projects, and reiterated: “The bedrock principle of judicial review in NEPA cases can be stated in a word: Deference.”[1] This decision comes as the federal government works to expedite what over the years have become lengthy NEPA review processes, and not long after the White House Council on Environmental Quality rescinded its NEPA regulations.
