Crowell & Moring, Planned Parenthood Federation of America, ACLU of Missouri, and ACLU Reproductive Freedom Project Achieve Victory in Reproductive Rights Case in Missouri

Washington – February 21, 2025: Missouri health care providers will be able to resume abortion care after a Jackson County Circuit judge temporarily blocked the Targeted Regulation of Abortion Providers (TRAP) last week. The TRAP restriction, Missouri’s abortion facility licensure requirement, had been left in place in a previous ruling and prevented providers, like Planned Parenthood, from resuming care, despite the state’s voters’ enacting an amendment on November 5, 2024, to enshrine a right to reproductive freedom in the Missouri Constitution. With this ruling, Missouri becomes the first state in the nation to restore abortion access after a total ban.

Mining, Indigenous Consultation Rights, and Investment Treaty Protection

This Alert, the first in a two-part series, surveys the legal landscape at the intersection of two issues that increasingly shape the outcome of mining and natural resources disputes regarding the protections available to foreign investors under investment treaties, as enforced through Investor-State Dispute Settlement (ISDS). The first is the prior consultation obligation imposed on States under the Indigenous and Tribal Peoples Convention, 1989 (No. 169), adopted by the International Labour Organization (ILO 169). The second is social license, the practical acceptance of a project by surrounding communities, which is distinct from but related to the formal State consultation duty. Navigating Disputes on Megaprojects Amid Trump Tariffs - Part 2

President-elect Donald Trump plans to impose widespread tariffs when he takes office in late January 2025. He has stated that one of his first executive orders will be to impose a 25% tariff on all products imported from Canada or Mexico. Products imported from China, such as metals, coatings, plumbing components and HVAC parts, could face an additional 10% tax above current tariffs. The imposition of such tariffs will have significant implications for megaprojects, including large infrastructure developments like highways, bridges, tunnels, airports, and railways, as well as large-scale energy projects like power plants, oil and gas facilities, and renewable energy installations.
