Crowell & Moring Files Amicus Brief Before Supreme Court on Behalf of HBCUs Leaders

Washington – August 3, 2022: On August 1, a Crowell & Moring team filed an amicus brief in the two affirmative action cases pending before the Supreme Court on behalf of leaders at Howard University and other Historically Black Colleges and Universities (HBCUs), as well as the National Association for Equal Opportunity in Higher Education, the national membership association of the nation’s 106 HBCUs. The HBCU leaders’ brief pointed to Harvard, the University of North Carolina, and other historically White universities’ long history of excluding Black students and its present-day effects, which include continued underrepresentation.

Crowell & Moring Files U.S. Supreme Court Brief on Behalf of the American Bar Association Calling for Review of When the Wrongfully Convicted Can Seek Damages

Washington – January 22, 2020: Crowell & Moring LLP filed an amicus brief on behalf of the American Bar Association in the U.S. Supreme Court in Louis Taylor v. County of Pima; City of Tucson (No. 19-756), supporting a petition for certiorari in a case concerning whether a wrongfully incarcerated person can be barred from seeking civil damages when his original convictions have been vacated, yet he has been released from prison on the condition that he plead no contest to time served. The ABA urges the high court to clarify the scope of Heck v. Humphrey, 512 U.S. 477 (1994), which held that, to recover damages under 42 U.S.C. § 1983 for an allegedly unconstitutional conviction or imprisonment, a plaintiff must show that the conviction or sentence has been reversed, expunged, or declared invalid in some way.

Preliminary Injunction Granted Against U.S. Government in Solar Energy Tariff Case

Washington – December 6, 2019: The U.S. Court of International Trade has granted a preliminary injunction prohibiting the federal government, including U.S. Trade Representative Robert Lighthizer and Acting Commissioner of U.S. Customs and Border Protection Mark Morgan, from implementing the withdrawal of a tariff exclusion for bifacial solar panels without due process. The government’s withdrawal comes only months after the tariff exclusion had been put in place following an extensive notice-and-comment process.
