San Francisco – February 10, 2021: Crowell & Moring advised Kountable Inc., the leading global trade and technology platform, in connection with its Series A-1 financing lead by Lateral Capital. Kountable secured this round of funding as part of its efforts to expand its U.S. presence and widen its COVID response to further support small and medium-sized enterprises (SMEs). The Kountable platform operates as the necessary missing element that gets critical goods delivered in difficult market conditions. For the past five years, Kountable has activated the capability of SMEs through is curated execution network to efficiently complete large scale projects for governments, foundations, NGOs, and corporations that have had a positive impact on millions of lives. Kountable has solved the challenges of collaboration between critical but overlooked SMEs who play a key role in the success of vast swaths of global trade activity, global multinational suppliers, funders, and logistics and trade services providers.

Washington – January 4, 2021: Crowell & Moring elected nine lawyers to the firm’s partnership, effective January 1, 2021. The firm also promoted 18 associates to the position of counsel. The new partners have been promoted from within the ranks of the firm’s Washington, Los Angeles, and New York offices and from across several practice groups, including Advertising & Media, Environment & Natural Resources, Litigation, International Trade, Antitrust & Competition, Government Contracts, and Intellectual Property.

As discussed in more detail here, the U.S. Department of War (DoW) recently issued a memorandum (Memo 26-P-1023, dated July 13, 2026) directing the immediate suspension of Cybersecurity Maturity Model Certification (CMMC) Phase II requirements (Level I and II self assessments are still permitted). Significantly, the memo directs that “all pending and future CMMC implementation milestones across DoW solicitations and contracts are held in abeyance until further notice.” Moreover, the DoW issued a memorandum on implementing these requirements (available here), directing agencies to issue amendments removing CMMC Level 2 and 3 requirements from active solicitations “as soon as practicable.” Contractors should monitor the government’s compliance with this requirement and should be prepared, if needed, to file a bid protest to protect their rights.

A recent U.S. Government Accountability Office (GAO) decision dismissing three pre-award protests as untimely highlights an important procedural trap for would-be protesters. In Oready, LLC, GAO dismissed three protests filed one business day too late, even though they were submitted prior to the solicitation closing date and time. 

On April 8, 2026, the Small Business Administration’s (SBA) Office of Hearings and Appeals (OHA) denied an appeal arguing that a concern’s early submission of its proposal with pricing was an attempt to “end-run the regulations” for when size is determined. In Size Appeal of DecisionPoint Corporation, SBA No. SIZ-6379, OHA confirmed that a company’s size is determined on the date it submits its initial offer which includes price, even if the proposal is submitted in advance of the proposal submission deadline and the offeror becomes large before the provided deadline.

On Tuesday, April 5, 2020 at 3 p.m. Eastern, Ken Dodds of Live Oak Bank, a leading SBA lender, will join Crowell & Moring attorneys and policy advisors in a webinar addressing the CARES Act’s Paycheck Protection Program (PPP).  Just over a week after the creation of this lifeline small business loan platform, the webinar will address updates to program eligibility, the current SBA Form 2483 borrower application, and loan calculations and forgiveness based on the SBA’s interim final rules and guidance that have been issued in the past week.

Join Crowell & Moring as we discuss what aspects of contract performance and teaming arrangements are being scrutinized (e.g., size/status eligibility, limitations on subcontracting compliance, reasonableness of market rates, etc.) and how these considerations can impact both small government contractors holding the prime contracts under review and their subcontractors.
