San Francisco – February 10, 2021: Crowell & Moring advised Kountable Inc., the leading global trade and technology platform, in connection with its Series A-1 financing lead by Lateral Capital. Kountable secured this round of funding as part of its efforts to expand its U.S. presence and widen its COVID response to further support small and medium-sized enterprises (SMEs). Washington – January 4, 2021: Crowell & Moring elected nine lawyers to the firm’s partnership, effective January 1, 2021. The firm also promoted 18 associates to the position of counsel. The new partners have been promoted from within the ranks of the firm’s Washington, Los Angeles, and New York offices and from across several practice groups, including Advertising & Media, Environment & Natural Resources, Litigation, International Trade, Antitrust & Competition, Government Contracts, and Intellectual Property.

Washington, D.C. – March 16, 2020: Fourteen Crowell & Moring lawyers have been named as 2020 Acritas Stars™, a listing of stand-out lawyers in private practice as nominated by clients. Acritas, a leading legal market research company, gathered feedback and data from more than 8,200 client interviews.

The San Diego Union-Tribune reports that a homeowners association (HOA) in California has reached an agreement with the Department of Justice (DOJ) to resolve allegations that the HOA obtained approximately $1.5 million in loans through the Paycheck Protection Program (PPP) that the HOA was not entitled to receive due to its status as a 501(c)(4) organization.  The HOA reportedly will pay $2,037,451 to resolve the allegations.  Of that amount, $244,494 will go to Wade Riner—the relator who initiated the action by filing a complaint under seal pursuant to the qui tam provisions of the False Claims Act (FCA).  According to the Tribune’s reporting, Riner has filed dozens of similar FCA suits across the country.

The National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2024, signed into law on December 22, 2023, makes numerous changes to acquisition policy. Crowell & Moring’s Government Contracts Group discusses the most consequential changes for government contractors here. These include changes that impose a new conflict of interest regime for government contractors with a connection to China, impose new restrictions and requirements, require government reporting to Congress on acquisition authorities and programs, and alter other processes and procedures to which government contractors are subject. The FY 2024 NDAA also includes the Federal Data Center Enhancement Act, the American Security Drone Act, and the Intelligence Authorization Act for FY 2024.

On October 5, 2023, the Information Security Oversight Office issued Joint Notice 2024-01: Joint Ventures and Entity Eligibility Determinations (Joint Notice) with the Small Business Administration (SBA) and in coordination with the Department of Defense (DoD) to provide government contractors with additional guidance concerning joint ventures (JVs) seeking access to classified information (an Entity Eligibility Determination (EED) or Facility Clearance (FCL)).  Among other things, this Joint Notice clarifies that companies should not rely on the SBA’s regulations for the proposition that a small business JV will never need to hold an EED. 

On Tuesday, April 5, 2020 at 3 p.m. Eastern, Ken Dodds of Live Oak Bank, a leading SBA lender, will join Crowell & Moring attorneys and policy advisors in a webinar addressing the CARES Act’s Paycheck Protection Program (PPP).  Just over a week after the creation of this lifeline small business loan platform, the webinar will address updates to program eligibility, the current SBA Form 2483 borrower application, and loan calculations and forgiveness based on the SBA’s interim final rules and guidance that have been issued in the past week.
