On December 20, 2018, the Fourth Circuit Court of Appeals affirmed a district court’s decision granting summary judgment in favor of an insurer, holding that under West Virginia law the insurer owed no duty to defend or indemnify a pain management medical office (doing business as “Responsible Pain”), or a doctor (the sole owner and also a named insured), for sexual misconduct claims asserted by five patients. State Automobile Mutual Insurance Company v. Allegheny Medical Services, No. 18-1558, 2018 WL 6720635 (4th Cir. Dec. 20, 2018).

On June 7, 2018, the Second Circuit Court of Appeals ruled that the standard to show evident partiality as a basis for vacatur under the Federal Arbitration Act (FAA) is different for a party-appointed arbitrator than it is for a neutral umpire. Certain Underwriting Members of Lloyds of London v. State of Florida, as Receiver for Insurance Company of the Americas, 892 F.3d 501 (2d Cir. 2018). 

The Association of Insurance & Reinsurance Run-Off Companies (AIRROC) will hold its First Annual West Coast Insurance and Reinsurance Conference at the Balboa Bay Club and Resort in Newport Beach, California.  Crowell & Moring is one of the co-chairs of this event.
