UT Law CLE's 33rd Annual Health Law Conference brings together leading in-house attorneys from major hospitals and medical institutions, government officials, as well as legal and financial advisors representing hospitals, health care providers, and physicians. The conference provides practical and detailed coverage of updates, current issues, and key strategies and opportunities facing members of the health care community.
Janet Walker, a senior counsel in the Washington, D.C. office, a member of the Health Care Group, and a Managing Director of Crowell Health Solutions, will be part of a panel on Thursday, April 7th at 10:45 a.m. entitled, "Paradigm Shifts in Managed Care and the Delivery of Health Care." During the session, attendees can learn about the transformational shifts in the managed care space accelerated by the pandemic, including a discussion on recent tensions between payors and providers, increased implementation of alternative payment models, and an examination of the increased focus on social determinants of health. The panel will address how these matters have and will affect hospitals, physicians, and other providers.

Has the Buss Stopped? Recoupment Today: In 1997, the California Supreme Court decided Buss v. Superior Court. In Buss, the court concluded that a liability insurer that defended a mixed action could seek reimbursement from the insured for the defense costs associated with the claims that were not even potentially covered. Since then, numerous courts have held that insurers are entitled to recoup their defense costs associated with uncovered claims or causes of action. On the other hand, a significant number of courts have rejected insurers’ right to recoupment, at least in the absence of a policy provision granting the insurer that right. Some commentators have even suggested that the current judicial trend might be away from permitting insurers to recoup their defense costs. Is that correct? Has the Buss stopped? This panel of coverage experts will analyze insurers’ claimed right to recoupment today, and offer their perspectives on what the law on recoupment should perhaps be and might be in the future.
