The Second Annual Conference on Dispute Avoidance and Resolution

Event | 08.30.07 - 08.31.07, 12:00 AM UTC - 12:00 AM UTC

In the first annual conference on Dispute Avoidance and Resolution (August 29-31, 2006 in Beijing) the focus lay on locating potential disputes in your organization. Now in our SECOND annual we plan to arm you with the silver bullets necessary to settle disputes over your international business. ADR (Alternative Dispute Resolution) itself is not a new concept but how to smartly use those tools might be a new challenge to your ever booming business.

If your organization places a high premium on reducing legal risks and reducing the high cost of disputes then we would like to invite you to take full advantage of this conference which is organized in comprehensive formats such as mock deposition, panel discussion, and key note presentation.

Alex de Gramont is Co-Chair of this conference. He and Kim Nobles will give a presentation entitled: "Successfully Invoking the Protections of International Investment Treaties and Laws." Crowell & Moring is a Lead Sponsor of the event.

Has the Buss Stopped? Recoupment Today

Has the Buss Stopped? Recoupment Today: In 1997, the California Supreme Court decided Buss v. Superior Court. In Buss, the court concluded that a liability insurer that defended a mixed action could seek reimbursement from the insured for the defense costs associated with the claims that were not even potentially covered. Since then, numerous courts have held that insurers are entitled to recoup their defense costs associated with uncovered claims or causes of action. On the other hand, a significant number of courts have rejected insurers’ right to recoupment, at least in the absence of a policy provision granting the insurer that right. Some commentators have even suggested that the current judicial trend might be away from permitting insurers to recoup their defense costs. Is that correct? Has the Buss stopped? This panel of coverage experts will analyze insurers’ claimed right to recoupment today, and offer their perspectives on what the law on recoupment should perhaps be and might be in the future.
