The 2010 NAPABA Convention

The National Asian Pacific American Bar Association ("NAPABA") is excited to announce its 22nd Annual Convention INSPIRE will be held November 17-21, 2010 in downtown Los Angeles. This will be the first time in over a decade that the NAPABA convention returns to California. Over 1,500 APA attorneys (in private practice, corporations, government, and the public sector), including General Counsels of Fortune 500 Companies, judges and law professors from all over the country will attend and who will be Inspired.

Beatrice Nguyen is the Program Chair & Moderator on the topic, "Trial Practice and Litigation Skills: Succeeding as an Asian Pacific American Lawyer in the Courtroom." Tacie Yoon is one of the Program Chairs on the topic, "Be Your Own Boss: How to Start Your Own Law Firm and Never Look Back." Van Nguyen is a Program Co-chair on the topic, "Breaking Barriers: Success Stories of Asian Pacific American Women Lawyers."

Has the Buss Stopped? Recoupment Today: In 1997, the California Supreme Court decided Buss v. Superior Court. In Buss, the court concluded that a liability insurer that defended a mixed action could seek reimbursement from the insured for the defense costs associated with the claims that were not even potentially covered. Since then, numerous courts have held that insurers are entitled to recoup their defense costs associated with uncovered claims or causes of action. On the other hand, a significant number of courts have rejected insurers’ right to recoupment, at least in the absence of a policy provision granting the insurer that right. Some commentators have even suggested that the current judicial trend might be away from permitting insurers to recoup their defense costs. Is that correct? Has the Buss stopped? This panel of coverage experts will analyze insurers’ claimed right to recoupment today, and offer their perspectives on what the law on recoupment should perhaps be and might be in the future.
