Recent enforcement actions by the Department of Health and Human Services Office for Civil Rights ("OCR") highlight the importance for covered entities to have effective compliance programs addressing the confidentiality and security of protected health information ("PHI"). One of these actions includes the first-ever imposition of civil monetary penalties ("CMPs") by OCR pursuant to the Health Insurance Portability Accountability Act ("HIPAA") as amended by the Health Information Technology for Economic and Clinical Health ("HITECH") Act.
