Event | 05.07.09, 12:00 AM UTC - 12:00 AM UTC

BIOCOM's 2009 DeviceFest promises to provide thought provoking panel discussions and case studies focusing on Inspiring Innovation, Overcoming Adversity In Product Development and What's Next? The Future of Innovation.

Medical devices have extended the ability of physicians to diagnose and treat diseases, making great contributions to health and quality of life. However, bringing life saving products to patients expeditiously remains a great challenge for medical device companies. The 21st century will be full of great corporate challenges in this arena and the question of how to achieve innovation efficiently and how to sustain this innovation will be at the forefront.

The day long conference will include BIOCOM's 4th annual award winning DeviceFest Exhibition, an exciting roundup of the hottest new medical devices currently on the market or nearing commercialization.

This venue is an opportunity for medical device companies to showcase one or more of their devices in a tradeshow setting to an audience of 150+ life science and medical device individuals, venture capitalists, media and more.

Karen Gibbs and Kim Nobles are attending this conference.

Has the Buss Stopped? Recoupment Today

Has the Buss Stopped? Recoupment Today: In 1997, the California Supreme Court decided Buss v. Superior Court. In Buss, the court concluded that a liability insurer that defended a mixed action could seek reimbursement from the insured for the defense costs associated with the claims that were not even potentially covered. Since then, numerous courts have held that insurers are entitled to recoup their defense costs associated with uncovered claims or causes of action. On the other hand, a significant number of courts have rejected insurers’ right to recoupment, at least in the absence of a policy provision granting the insurer that right. Some commentators have even suggested that the current judicial trend might be away from permitting insurers to recoup their defense costs. Is that correct? Has the Buss stopped? This panel of coverage experts will analyze insurers’ claimed right to recoupment today, and offer their perspectives on what the law on recoupment should perhaps be and might be in the future.
