Advanced Agency & Distribution 2009: Managing the Commercial and Competition Law Risks On and Offline
Event | 10.06.09, 12:00 AM UTC - 12:00 AM UTC
IBC Legal Conferences presents its 4th annual event Advanced Agency & Distribution.
This one-day conference reviews the legal, commercial and competition law differences between agents and distributors and their rights and obligations.
Designed for in-house lawyers, private practitioners and regulators, this annual event will also explore the application of the competition rules and how companies can take a robust view of any concern.
The complexity of agency and distribution agreements and relationships is increasingly being manifested in significant legal and regulatory developments:
- greater scrutiny by competition authorities of relations between commercial parties
- new and convoluted legal disputes arising from on and offline selling
- continually developing case law in various European jurisdictions
- inconsistent court rulings
Recent developments of special note include:
- the practical impact of the reform of the vertical block exemption
- the OFT’s investigations into retailers and suppliers.
Leading experts from a diverse background will discuss and analyze crucial developments and practical challenges.
Thomas De Meese is part of a panel at this conference.

Has the Buss Stopped? Recoupment Today
Has the Buss Stopped? Recoupment Today: In 1997, the California Supreme Court decided Buss v. Superior Court. In Buss, the court concluded that a liability insurer that defended a mixed action could seek reimbursement from the insured for the defense costs associated with the claims that were not even potentially covered. Since then, numerous courts have held that insurers are entitled to recoup their defense costs associated with uncovered claims or causes of action. On the other hand, a significant number of courts have rejected insurers’ right to recoupment, at least in the absence of a policy provision granting the insurer that right. Some commentators have even suggested that the current judicial trend might be away from permitting insurers to recoup their defense costs. Is that correct? Has the Buss stopped? This panel of coverage experts will analyze insurers’ claimed right to recoupment today, and offer their perspectives on what the law on recoupment should perhaps be and might be in the future.
