Crowell & Moring Associate Gage Javier, a member of the firm's Privacy & Cybersecurity Group, will be moderating and speaking at ACC's 2023 Cybersecurity Summit taking place May 8th and 9th at UCLA Meyer and Renee Luskin Conference Center in Los Angeles, CA.
On May 8th, at 9:00 a.m. PT, Gage will be moderating "The State of Cybersecurity Report Overview" session. In boardrooms and GC offices across the nation, one risk stands above: “cybersecurity.” As a rapidly evolving threat, in-house law department cyberlaw programs must also evolve to meet it and in-house lawyers must have the insight and knowledge needed to craft a finely tuned cyberlaw program. The ACC Foundation’s Bi-Annual “State of Cybersecurity” Report represents one of the most valuable resources that companies can turn to. This report sheds light on the growing role that legal departments are playing in organization-wide cybersecurity policies and practices. Our panel of senior in-house and academic experts will discuss evolving legal practices, risk management tips, and legal ops best practices based on the Report highlights.
On May 9th, at 11:00 a.m. PT, Gage will be speaking on the "Aftermath of a Cyber Incident" session. This panel of subject matter experts will discuss the steps that in-house counsel and plan administrators (incident response managers), responsible for their company’s Data Incident Response Program, will take after having learned of a cyber incident.
Cybersecurity touches every aspect of consumer and corporate culture, and vulnerabilities present grave financial, legal, and reputational risks. Preventing, preparing for, and responding to data breaches in real time are chief concerns in today’s workforce. This conference programming will keep you apprised of the latest threats and innovations through educational sessions with leading subject matter experts. These learning opportunities will complement your broad understanding of cybersecurity strategies and principles, enabling you to become a more well-rounded, focused, and effective practitioner. This conference is geared towards law firms, corporations, and government officials.

Has the Buss Stopped? Recoupment Today
Has the Buss Stopped? Recoupment Today: In 1997, the California Supreme Court decided Buss v. Superior Court. In Buss, the court concluded that a liability insurer that defended a mixed action could seek reimbursement from the insured for the defense costs associated with the claims that were not even potentially covered. Since then, numerous courts have held that insurers are entitled to recoup their defense costs associated with uncovered claims or causes of action. On the other hand, a significant number of courts have rejected insurers’ right to recoupment, at least in the absence of a policy provision granting the insurer that right. Some commentators have even suggested that the current judicial trend might be away from permitting insurers to recoup their defense costs. Is that correct? Has the Buss stopped? This panel of coverage experts will analyze insurers’ claimed right to recoupment today, and offer their perspectives on what the law on recoupment should perhaps be and might be in the future.
