ACC Brazil - Drafting & Interpreting Contracts in Latin America

Event | 02.09.12, 12:00 AM UTC - 12:00 AM UTC

Presented by ACC's International Legal Affairs Committee and sponsored by Crowell & Moring LLP, as well as Lloreda Camacho & Co., and Arias, Fabrega & Fabrega.

When it gets to negotiating and drafting contracts, in-house counsel's role is of paramount importance. In doing so, the main challenge that in-house counsel face is whether the allegedly crystal-clear, bullet-proof, comprehensive and well drafted contract will allow the company (and the other party), to achieve the business objectives it had in mind when it decided to execute it; moreover, in case things go wrong, whether such contract will be interpreted and enforced as it was initially intended. With the foregoing view, the purpose of this webcast is to provide in-house counsel with insights from three different jurisdictions (Brazil, Colombia and Panama) on the main challenges arising from the interpretation in Latin America of contracts drafted under U.S. Standards, as well as their implementation and enforceability in these three jurisdictions.

Harry Burnett is representing Crowell & Moring as a speaker, and Erica Franzetti, Cristina Ferraro and Gabriel da Costa will also participate on the call.
